Terms & Conditions of Sale – Brabantia Ghana Webshop

1. Definitions

1.1 “Buyer” refers to any individual or entity purchasing Goods from this website.

1.2 “Goods” means the products or merchandise offered for sale by the Seller.

1.3 “Seller” means Napev Limited - Registration number: CS075432016 - VAT Registration number (TIN): C0004982703

2. General

2.1 These Terms and Conditions govern all sales of Goods by the Seller to the Buyer, to the exclusion of any other terms or conditions not expressly agreed in writing.

2.2 No variation or amendment to these Terms and Conditions shall be binding unless agreed in writing by both parties.

3. Price and Payment

3.1 Prices shall be those displayed on the website at the time of purchase, subject to any applicable discounts agreed in writing. Prices include VAT and other applicable taxes unless stated otherwise.

3.2 Full payment is required prior to the dispatch of Goods.

3.3 In the event of delayed payment, and failure to remedy such default within seven (7) days after receiving written notice, the Seller may:

3.3.1 Demand advance payment for any outstanding or future deliveries;

3.3.2 Withhold delivery of any pending orders without liability for delay or non-delivery;

3.3.3 Recover all reasonable legal and collection costs incurred in pursuing outstanding payments;

3.3.4 Retain ownership of the Goods until full payment is received.

4. Delivery

4.1 Delivery shall be made to the address specified by the Buyer, on the agreed date and time. The Buyer must ensure readiness to receive the Goods.

4.2 Unless otherwise agreed, delivery will occur within seven (7) working days of order confirmation.

4.3 If delivery is hindered due to the Buyer’s actions or omissions, the Seller may place the Goods in storage at the Buyer’s cost.

4.4 Goods must be inspected within forty-eight (48) hours of receipt. Claims for missing, incorrectly delivered, or visibly damaged Goods must be made within this period.

4.5 Claims for shortages, over-deliveries, or damage must be reported within seven (7) days of delivery.

5. Return of Non-Defective Goods

5.1 Returns must be pre-authorized in writing by the Seller.

5.2 Where accepted, the Buyer may be responsible for return shipping costs and must ensure proper packaging to prevent transit damage. Goods returned damaged will not qualify for credit.

6. Risk and Title

6.1 Risk transfers to the Buyer upon delivery.

6.2 Title remains with the Seller until full payment is received.

7. Limitation of Liability

7.1 The Seller shall not be liable for indirect or consequential losses, unless arising from a breach of confidentiality or intellectual property obligations.

7.2 Nothing in these Terms excludes liability for death or personal injury caused by the Seller’s negligence.

8. Waiver

Failure to enforce any provision of these Terms shall not be deemed a waiver of the right to enforce it at a later time.

If the qualifying items are kept, the customer may retain the gift. Failure to return a qualifying gift will result in the deduction of its value from the refund.

Unless otherwise specified, the minimum qualifying order value for promotional offers is GHS 500.
